If you don’t have a cookie banner, you can be in violation of privacy regulations like the GDPR in the EU, LGPD in Brazil and PIPEDA in Canada. 

Non-compliance: Many data privacy laws require website publishers to inform users about the use of cookies and obtain their consent. Cookies can store personal information and therefore are considered a part of personal data. Any violation in processing personal data can have legal consequences. 

Monetary fines: You may also face potential monetary penalties for non-compliance with cookie consent laws. For instance, in 2023, France’s data protection regulator, CNIL, fined TikTok €5 million for making it difficult for users to refuse cookies on its website.
