Do you need consent for analytics cookies?

Analytics cookies are cookies that are used to understand how users navigate and interact with a website. According to the General Data Protection Regulation (GDPR) and the ePrivacy Directive analytics cookies require active user consent

Any cookies other than strictly necessary cookies require consent from users and as analytic cookies are not strictly necessary, websites should obtain consent before setting them on a user’s browser. However, French (CNIL) allows consent exemptions for analytics cookies, provided certain conditions are met.

In California Consumer Privacy Act (CCPA), businesses are required to disclose their use of cookies and provide users with the option to opt-out of the “sale” of information. In terms of analytics cookies, the interpretation of their use may depend on the contract in place with the third party.
