This Fair Use Policy ("Policy") applies to all users of the Services provided by CookieYes ("Company"), including users on Free, Basic, Pro, and Ultimate plans. The purpose of this Policy is to ensure that all customers enjoy reliable, secure, and equitable access to the Services, and that system resources are not subject to abuse or disproportionate consumption by any individual account.

What is a Fair Use Policy?

A Fair Use Policy ensures that all users have equitable access to the Services by preventing excessive or abusive usage that could harm system performance or stability. It protects the platform from resource misuse, helps manage infrastructure costs, and supports a clear upgrade path as user needs grow. This allows the Company to offer reliable service to everyone while maintaining fairness and sustainability across all plans.

Why do CookieYes have one?

CookieYes has a Fair Use Policy to ensure reliable service for all users. In rare cases, a small number of users may hit usage limits that go beyond what their plan is designed to support. The policy helps prevent such excessive use from affecting overall system performance and ensures that resources are fairly shared across all accounts.

The Policy

1. Free, Basic, and Pro Plans

Each subscription plan includes a defined monthly page-view allowance as set out in the applicable pricing or plan description.

Where the applicable page-view allowance is exceeded:

  • Free plan: functionality may be suspended until the next billing cycle or the user may be required to upgrade.
  • Basic and Pro plans: additional page views may be charged on a usage-based basis in accordance with the applicable pricing, or the user may be required to upgrade to a higher plan.

The Ultimate plan includes unlimited page views, subject to fair use.

2. Ultimate Plan

2.1 Normal Use

For the purposes of the Ultimate Plan, Normal Use refers to usage patterns that align with the typical sustained pageview volumes observed across Ultimate Plan customers, reflecting standard website traffic levels and ordinary commercial deployment.

2.2 Excessive Use

Usage may be considered excessive where sustained pageview volumes materially exceed Normal Use, particularly where such usage indicates non-standard deployment patterns or disproportionate consumption of service resources.

2.3 Review and Customer Notification

Where usage significantly exceeds Normal Use, we may review the account to ensure continued service stability and fair allocation of platform resources.

In such cases, we will typically contact the customer to discuss the usage pattern and explore appropriate scaling options. These scaling options may include:

  • recommend migration to a custom or enterprise plan;
  • apply usage-based pricing appropriate to the scale of deployment; or
  • implement reasonable technical limitations where necessary to ensure service stability.

Unexpected Usage Patterns

The Company reserves the right to immediately suspend or terminate accounts exhibiting abnormal, automated, or abusive patterns of usage that compromise system performance or integrity, regardless of plan level. Such patterns may include, without limitation, excessive automated requests, attempts to circumvent service safeguards, or usage volumes materially inconsistent with the intended purpose of the subscribed plan. Where feasible, the Company may provide notice or impose usage limits prior to suspension or termination.

Changes to This Policy

The Company reserves the right to change this policy from time to time at its discretion. Material changes will be communicated through the website or via email where appropriate.
